The BZA is judiciary
in nature and has the authority to hear and decide variances from certain zoning
regulations; approve conditional uses and hear and decide appeals from the decision
of the Zoning Inspector.
Under certain conditions,
property owners may request a variance from strict compliance to the Regulations.
Setbacks, size of signs and size of buildings are frequent subjects of the variance
process.
In some zoning categories,
specific uses are not permitted except when certain conditions are set by the BZA.
Applicants wanting those uses must apply for a Conditional Use and have their cases
heard by the Board.
A major job of the
Zoning Inspector is to enforce the Zoning Regulations. Enforcement actions may be
appealed to the BZA.
Like the Zoning Commission,
the BZA operates under the authority of Section §519 of the Ohio Revised
Code. Unlike the Zoning Commission, however, BZA members may deliberate on their
decisions privately, once they have heard all the evidence on each case in a public
hearing. They must then return to the public meeting to render their decision. Also,
the BZA’s decision is final and appealable only to a court of common pleas.
Each member is appointed by the Township Trustees for a five-year term and must
be a resident of the unincorporated area of Jefferson Township.
